Nigerian woman charged in US over illegal voting

Gladys Adaeze Okafor, a 56-year-old Nigerian citizen and Lynn, Massachusetts resident, was arrested in Boston, Massachusetts, on Wednesday, 16 September 2026, and charged with unlawfully voting as a non-citizen after federal prosecutors alleged that she falsely declared herself a United States citizen on voter registration forms and subsequently voted in the 2022 midterm election and the 2024 presidential primary.

The arrest was announced by the United States Attorney’s Office for the District of Massachusetts, which said Okafor was taken into custody on Wednesday morning and was expected to appear in federal court in Boston later that day. Homeland Security Investigations is involved in the case.

According to the federal complaint, Okafor was born in Aba, Nigeria. She obtained lawful permanent resident status in December 2022 but was not a US citizen and had not applied for US citizenship, prosecutors said.

The case centres on two voter registration forms submitted in Massachusetts.

In July 2022, prosecutors allege, Okafor submitted a voter registration card in Lynn and signed a certification stating that she was a US citizen.

The City of Lynn subsequently registered her to vote, and federal authorities allege that she cast a ballot in the 2022 midterm election.

The charging documents indicate that the registration occurred before Okafor obtained permanent resident status later that year.

Her immigration status did not make her eligible to vote in federal elections, however, because lawful permanent residence is distinct from US citizenship.

Federal prosecutors further allege that Okafor submitted another voter registration form in October 2023.

On that form, she again marked the box indicating that she was a US citizen and signed the accompanying certification.

The complaint says she subsequently voted in the 2024 presidential primary election.

The distinction between a presidential primary and the general presidential election is significant.

The federal case currently concerns the 2024 primary, rather than an allegation that Okafor voted in the November 2024 presidential election.

Fox News reported that prosecutors allege Okafor admitted during a recorded interview with a Homeland Security Investigations agent that she voted in the 2024 primary.

The federal charging document remains the controlling source for the allegations in the criminal case.

US federal law prohibits non-citizens from voting in elections held wholly or partly to select the President, Vice-President, presidential electors, members of the Senate or members of the House of Representatives.

The Justice Department has brought other cases this year under the same federal voting provision.

The charge against Okafor carries a maximum sentence of one year in prison, one year of supervised release and a fine of up to $100,000, according to the Massachusetts US Attorney’s Office.

Prosecutors also said she could face deportation after completion of any sentence imposed.

Any eventual sentence would be determined by a federal judge under applicable law and the US Sentencing Guidelines.

The prosecution comes as federal authorities in Massachusetts have placed increased emphasis on investigating suspected voter and benefit fraud.

US Attorney Leah B. Foley announced the creation of the district’s Benefit & Voter Fraud Team on 26 March 2026.

The initiative was established to investigate suspected fraud involving public benefits and voting in Massachusetts.

The Department of Justice also established its National Fraud Enforcement Division in April 2026.

The division’s stated mandate is to investigate and prosecute fraud affecting the federal government, federally funded programmes and taxpayer resources.

The broader enforcement effort provides context for the timing of the Okafor case, but it does not establish any wider pattern from this individual prosecution.

The evidence and allegations against Okafor will have to be tested through the federal court process.

The federal complaint provides specific allegations about the registration forms and voting activity, but those allegations have not yet been established as facts at trial.

The US Attorney’s Office has stressed that position, stating that the details contained in the charging document are allegations and that Okafor is presumed innocent unless and until she is proven guilty beyond a reasonable doubt.

For Okafor, the case now moves from an investigation into a formal federal prosecution, with the potential consequences extending beyond a criminal sentence to her immigration status.

The allegations also highlight the legal distinction between holding lawful permanent resident status and being a US citizen.

A green card permits permanent residence but does not, by itself, confer eligibility to vote in federal elections.

As the case proceeds, the central questions will be whether prosecutors can establish the alleged false citizenship certifications and voting activity beyond a reasonable doubt, and what consequences, if any, a federal court ultimately determines are appropriate.
