The legal action, which forms the basis of the ADC suit against Ireti Kingibe, was initiated 48 hours after the ward executive committee placed the senator on indefinite suspension over alleged anti-party activities, insubordination and violation of party rules.
The plaintiffs in the case are Okezuo Kanayo, chairman of the ADC in Wuse ward, and Isaiah Samuel, the ward secretary.
In the suit marked FHC/ABJ/CS/539/2026, the plaintiffs asked the court to declare that the Wuse ward executive committee possesses the constitutional authority to discipline and suspend members within its jurisdiction.
The plaintiffs, represented by lawyer Maxwell Opara, also urged the court to affirm that the suspension imposed on the senator remains valid and in force.
Among the reliefs sought is a declaration that Kingibe cannot lawfully present herself as a member or card-carrying member of the ADC while the suspension remains effective.
The plaintiffs further asked the court to rule that the party’s National Working Committee should not recognise the senator as a member at any level during the period of the suspension.
According to court documents, the suit was filed pursuant to Sections 6(6)(b) and 251 of the Constitution of the Federal Republic of Nigeria 1999, as well as Article 16 of the ADC constitution and Order 3 Rules 6 and 7 of the Federal High Court (Civil Procedure) Rules 2019.
The plaintiffs also requested the court to determine whether the Wuse ward executive committee has the legal power to discipline and suspend members of the party within its jurisdiction.
